What is Local Law 97?

LL97 NYC, enacted in 2019 and amended in 2021, mandates that large buildings (over 25,000 square feet) meet stringent greenhouse gas (GHG) emissions limits. The goal is to reduce NYC’s overall emissions by 40% by 2030 and achieve net-zero emissions by 2050. This law sets specific compliance requirements for building owners and managers, creating both challenges and opportunities for improving energy efficiency.

Who Does It Apply To

LL97 applies to buildings with the following criteria:

  • Buildings over 25,000 gross square feet
  • Two or more buildings on a single tax lot that together exceed 50,000 square feet
  • Two or more condominium buildings governed by the same board of managers that exceed 50,000 square feet

These buildings are subject to the law starting in 2024, with stricter requirements coming into effect in 2030. It’s essential to verify if your building qualifies and understand the specific compliance pathway. Working with NYC Local Law 97 building consultants can help you navigate the regulations, assess your property’s emissions, and develop a strategy to meet compliance targets efficiently.

What Is Required and When?

To comply with LL97 NYC, building owners need to:

  • File an Annual Report: Starting May 1, 2025, building owners must report their building’s GHG emissions. This report must be certified by a registered design professional (RDP) and submitted annually.
  • Meet Emission Limits: Your building’s GHG emissions must not exceed the limits set by the law. These limits will become progressively stricter, with deadlines in 2024, 2026, and 2030.
  • Submit Compliance Documentation: Additional compliance documentation may be required based on your building’s characteristics and pathway under LL97.
Failure to comply with LL97 NYC can result in significant fines:
  • Excess Emissions: $268 per metric ton of excess CO2e
  • Failure to File Annual Report: $0.50 per square foot per month for late submissions
  • Failure to Submit Compliance Statement: $5,000 for the first year, plus $500 per month thereafter
  • False Statements: Fines up to $500,000
