What Is Local Law 84?
The goal?
Through the NYC Benchmarking Law, the city aims to improve building efficiency, reduce greenhouse gas emissions, and lower energy costs for building owners and tenants.
The data is submitted through the Energy Star Portfolio Manager®, an online tool by the U.S. Environmental Protection Agency (EPA) that compares your building’s energy performance against similar properties nationwide.
Who Does It Apply To
Local Law 84 NYC applies to buildings that meet one of the following criteria:
- Buildings exceeding 25,000 gross square feet
- Groups of buildings on the same tax lot totaling 100,000 square feet or more
- Condominium buildings governed by a single board exceeding 100,000 square feet
- Certain City-owned properties
If your building is listed on the Covered Buildings List (CBL), it must comply with the benchmarking requirements for the upcoming year. The list is updated annually, so it’s essential to check your building’s status each year.
Not sure if your building is covered? You can check your building’s status on the Covered Buildings List (CBL), which is made available every February.
What Is Required and When?
To comply with LL84 NYC, building owners must:
- Collect the required energy and water consumption data for the entire prior calendar year (January 1 to December 31)
- Submit the benchmarking report via the Energy Star Portfolio Manager® by May 1st each year. This report must include both energy and, if required, water consumption data.
Failure to comply with LL84 can result in penalties of up to $500 per quarter. These fines accrue monthly until compliance is achieved. Don’t let missed deadlines impact your budget—NECS ensures you stay ahead of the curve.
